|
As we
all know, the revenue records of Stage-I -Survey
No. 12 is still
Download under name
of the original owners. This is a granted property to the daliths.
There is a background to this issue. It has now become a
major issue that requires our immediate attention of all
site owners to take a joint action.
There will be an emergency meeting on
Friday 11th May 2007 at 12:30Pm
at United Indian School, Jaleeb Shyukh, to discuss the
further action to be taken. The details of the present
situation in Athina also will be discussed in the meeting.
Those wish to join the litigation may come for the meeting
and this will be the last chance to
join the litigation. Those who are not having the
original documents can join with the photocopy of the
documents with the respective charges and may send the
original documents later.
We
request ALL members of ATWS especially owners of
Athina Stage I - Survey No. 12 to attend this meeting
without fail since we have to take some important decisions.

To discuss and decide very important issues
( About 12 Acres of land with SC/ST problem in 1st Stage)
there will be an urgent meeting exclusively for all site
owners of 1st stage Athina Town Dodda Gubbi.
The venue is United Indian School Abbasiya and time on
Sunday 22nd April 2007 at 7PM.
All site owners of 1st
stage are requested to attend the meeting. The intended
General Body Meeting of all site owners in both 1st and
2nd stge will be announced later. Please pass this message

Litigation News Update - 08-04-2007 |

LITIGATION AGAINST JOSEPH
CHACKO & CITISCAPE PROPERTIES
The court hearing was held on
30-03-07, as scheduled. The Second defendant, Citiscape
Properties stated that they have no claims over Athina
Township and that they have no objection to pass any orders.
However, the First defendant, Joseph Chacko contested for
more time to file his objections. Accordingly, the court
adjourned for next hearing on 30-05-07.
SITE OWNERS AFFECTED BY
CABLE SHREEDHAR'S OCCUPATION
It has been noticed that about 6 acres of
land in Athina Township has been compounded by one Cable
Shreedhar, following a litigation between Joseph Chacko and
one original land owner family late last year. Even though
the litigated property was 1.66 acres only, a much larger
area is presently under the occupation of the said Cable
Shreedhar. It is believed that there was some connivance
between the parties that led to this blatant land grabbing!

It has been decided in
the General body meeting held on 16th March that all members
should pay Rs. 10/- per sqf. immediately to meet the urgent
need of society to complete the infrastructure and other
basic needs of the township. We request all ATWS members to
pay the due amount immediately. You may contact the
treasurer, Mr. James Luke on Tel. No. +965-434 0388 (Res)
and settle the dues.

Important decisions
taken in the General Body Meeting |
The General body meeting held
on 16th March decided to raise the fund immediately to
support Mr. George Varghese’s efforts in Bangalore to
resolve the present crisis of Athina Township.
A Sub Committee consists of Mr. James Luke, Mr.Philip Mathew
and Mr. Mithilesh Gadkary formed for an immediate collection
of maintenance charges. The meeting authorized the above sub
committee to collect all the due amounts from all the site
owners to meet the immediate expenditure. It has been
decided earlier that all members to contribute Rs.10/sq.ft
as maintenance charge in addition to the membership fee of
Rs. 3000/- and litigation charge of Rs. 10,000. Those who
have not paid the full amount are requested to pay the
balance immediately.
Based on the report received from Bangalore that there is no
problem in the second stage of Athina Ttownship, Mr. Jacob
Thomas told the audience that they can proceed with the
construction of houses in their plots. Those who are willing
to build houses may coordinate with our members Mr.Thomas
Philip and Mr. Mathew Joseph Panicker. They are entrusted to
get quotation from desirable contactors within two weeks. |

A General
Body meeting of the Athina Township Welfare Society will be
held at United Indian School, Abbasiya on Friday 16th March
2007 at 12:30 pm.
In this meeting we need to take some very important decision
on various issues. Since we have been given the deadline
from the court as March end to submit the documents, we once
again urge the plot owners to send their documents for
litigation immediately.
Those who have sent the documents directly to Bangalore,
please fill the following information to match with our
record.
We request all members to
co-operate and be present the meeting. Please also pass this
information to other members whom you know personally.

Beware of Spam Mails |

All ATWS
members are requested to IGNORE the spam mails sending to
members with wrong and misleading information
regarding our Township. Members are receiving mails from a
person called
Abraham Idicula,
who is neither a member of our
society nor a plot owner of Athina I & II. He is trying to
confuse and discourage the members from litigation
and possession of land. Please respond only to the mails
from the officials of ATWS.

*Attention : To those who wish to take immediate possession
of land |

Dear Friends,
The meeting of Athina Township Welfare Society on 5th March
2007 went on well.
According to the information received from our Vice
President, it is the right time to occupy the land
and construct some permanent structures in the property and
it is a must now. A strong reason behind the success of our
case so far was the few houses built in our layout. Few of
our members came forward to start building houses. Those who
are planning to build the houses may contact the Secretary
or Mr. Gigi Thomas (Tel: 9893093) for further discussion. We
will have a meeting of site owners who are
ready to build the house immediately at United
Indian School, Abbasiya, Kuwait on Friday 9th March at
2.00pm. We will forward the minutes
of the meeting held on 5th March soon.

The actions taken by the
Society at various levels has started giving results. Chacko
has submitted a letter to the Police in order to exonerate
him from the recent encroachment case. In this letter he has
declared that he did sell the lands to the NRIs many years
ago and that he has no claim whatsoever over the lands and
the site owners are free to enjoy them!
The Cityscape Properties, the main aggressor, is retreating.
They are bullying the issue using the Daliths card.
Aggressors have by now lost all other cards. It is a
sensitive matter that is being handled tactfully.
Our civil case proceedings against Joseph Chacko and
Cityscape continues.
Some site owners have apprehension whether to do any further
investment at all prior to the civil case verdict. We wish
to reiterate that we are given police protection for the
simple reason that we are the rightful owners. The civil
suit is filed to endorse our ownership title from future
misadventures.
According to Karnataka land rules, vacant lands are at risk
of government take over. However, lands owned and possessed
by the holders are usually spared. Government has respected
Society’s representations given at various levels, and we
are given a mandate to reestablish the layout and to take
possession expeditiously. We could convince the officials
that we are in possession of the lands, thanks to some of
the site owners who dared to build houses and compound walls
without guarantees.
However, the police protection given to our layout cannot go
indefinitely. Our immediate need is to reestablish the
demarcation, infrastructures and utilities. It is estimated
to cost around Rs 20 per sq.ft to meet the current needs.
All site owners are requested to understand the urgency of
the matter and pay your dues to the Society's Bank

Court has adjourned the hearing to 30th March 2007 |
Our file
suit was heard 2 days ago and it is adjourned for 30th
March. The judge was not convinced of our petition for
injuction order as it lacks representation of site owners.
However the judge has ordered to send emergency notice to
the defendants to respond before 30th March. The judge
stated there are wider ramifications for this case,
therefore to be heard from the defendants too.
The
police protection for the layout continues. We are doing
everything possible to keep the police on the ground
because the SC/STs will repossess the area and install
huts if the police leaves.

We have to discuss and take very important decisions in this

04-02-2007 Goondas have been thrown
out from ATHINA |
|
We have been
informed by our Vice President Mr. George Varughese from
Bangalore that as a result of CMO's firm intervention, the
IG has send special order to send the police force to our
layout. The police force have been deployed at ATHINA
yesterday and 'goondas' have been thrown out from the
layout. However, this is a temporary relief only.
Therefore, we are asked to obtain immediate favorable court
orders to enjoy continued govt. protection. We request all
Athina plot owners to unite together to get our legal
rights. Though the present police action is done for the
whole layout, the court will consider the case as an
individual case for each plot owners separately. So we urge
the members of ATWS who have not yet send their documents to
send it immediately and those who have not yet joined the
society to join the society without further delay. IT IS A
MUST IF YOU WANT TO WIN YOUR CASE. We have a mail going
today to Bangalore (from Kuwait) and if anyone wants to send
their documents, may contact us before 1.00 pm.

We have
received a copy of letter issued from Prime Ministers' office to the Chief
Secretary, Govt. of Karnataka, Bangalore to take
appropriate action against the letter received from
Sri. M. K. Koshy (President ATWS) and others.
We are
receiving positive response from Bangalore that serious
actions are been taken from the Government officials against
our petition. Our vice president Mr. George Varughese and
our Attorney is working so hard to resolve the issues and
the litigation is in progress. Please note that the society
is working only for the "registered members" who had
send their required documents along with the litigation
expenses.

documents are been sent to Bangalore to the Attorney. We
urge all other members to prepare and send the documents
